About the Position
The charging of a felony is one of the most challenging and important decisions a prosecutor can undertake in their duties. Careful evaluation of a submittal before charging is critical. A thorough review of available evidence and the applicable criminal statutes is necessary to ensure that cases are not charged unless there is a reasonable likelihood of conviction based on constitutionally obtained and admissible evidence. The charging decision often includes communication and coordination with law enforcement. If the suspect is in custody, the Charging Attorney may only have a few hours reviewing the submittal and making a charging decision. The Charging Attorney must be familiar with and able to navigate both MCAO and Superior Court databases competently.
This recruitment is utilized to fill Attorney II positions. The level and compensation offered will be based on education and experience provided on the application.
Attorneys hired at a level II will be compensated at a range of $35.50 - $40.41

We Require
  • Juris Doctor degree from an American Bar Association (ABA) approved law school
  • Five years of experience as an attorney
Other Requirements
  • Must be admitted to practice law and be in good standing with the State Bar of Arizona by the time of hire
  • Valid AZ driver's license upon hire
  • Must obtain ACJIS Terminal Operator Certification within six months of hire or promotion and maintain certification throughout this assignment
  • May require on-call/overtime availability to respond to after-hour inquiries and notification alerts
  • May be required to travel to perform certain work functions
  • Must have the ability to obtain and maintain a security clearance

Job Contributions
  • Review submittals from law enforcement and makes appropriate charging decisions within applicable time limits
  • Communicate effectively with law enforcement, the court, and other agency and community partners
  • Review risk assessments, criminal history, and the facts of the crime to make appropriate release recommendations to the judicial officer
  • Review and respond to motions in felony cases as assigned
  • Comply with all rules regulating professional responsibility
  • Cover court and other duties as assigned
  • Navigate effectively in MCAO and Superior Court databases
Working Conditions
  • Office and courtroom are set in a high volume, fast-paced environment with frequent stressful situations
  • May require extended periods of sitting while completing paperwork, standing, and moving about during performing duties
  • Ability to travel to and from various County locations for court appearances, meetings, and training, utilizing personal or County-owned vehicles
  • Ability to move up to 20 pounds
