Job description

Roberts & Holland LLP, a mid-sized New York City law firm, is seeking an associate for our employee benefits and executive compensation practice group. We provide advice relating to tax-qualified retirement plans, welfare plans and executive compensation arrangements for clients in a variety of industries, including professional sports, real estate, insurance, consulting, and hotel operations.

The ideal candidate would have two to eight years of law firm or in-house experience handling ERISA compliance matters relating to retirement and welfare plans. With respect to education, a JD from a top-tier law school is required.

The primary responsibilities of the position are as follows:

  • Draft plan documents and participant communications and forms relating to retirement benefit arrangements, such as 401(k) plans, traditional defined benefit plans, insured annuity programs and nonqualified deferred compensation plans.
  • Serve as a day-to-day point of contact for clients and other service providers in order to resolve legal and operational issues in connection with retirement plans that are subject to ERISA and/or the Internal Revenue Code (including Section 409A).
  • Advise clients on implementation and ongoing compliance issues regarding welfare benefit programs, including insured medical plans, healthcare reimbursement accounts and flexible spending accounts.
  • Perform research on sophisticated tax and ERISA issues and prepare written communications summarizing and analyzing the research.
  • Review and negotiate service provider agreements relating to ERISA plan investments, as well as plan administration and consulting services.
  • Represent clients in connection with Internal Revenue Service and Department of Labor compliance filings for benefit plans.
  • Draft language to be included in collective bargaining agreements relating to employee benefits matters, including new benefit plan designs.
  • Evaluate ERISA representations in transactional documents.
  • Advise clients on prohibited transaction issues relating to IRA and/or ERISA plan investments.
  • Assess legal issues and advise clients regarding the establishment of other employee benefit arrangements, such as tuition reimbursement, employee assistance and legal services programs.

The position will be full-time and based in our New York City office.

Pay: $200,000.00 - $215,000.00 per year
