Job description
The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions. The Department also represents the State in criminal appeals from state trial courts, and brings legal actions on behalf of the state and its citizens when the public interest is at stake.

  • This position will provide legal counsel to HR and be a member of the General Counsel’s office. It will support a variety of legal issues; procurement and acquisition law; employment and personnel law; government ethics; fiscal law; general administrative law; privacy and civil liberties; and legislative affairs
  • This position will be responsible for providing position statements and responding to EEOC and OAH charges in addition to providing counsel and support for agency HR litigation
  • Furthermore, this position will advise management on a variety of diversity and inclusion issues, assist with the grievance process and compliance with state and federal law
  • Provide strategic counsel to NC DOJ HR and other internal DOJ clients regarding policy, employee relations, and other HR-related matters
  • Provide legal advice and policy counsel
  • Conduct legal research on sensitive matters
  • Provide training on a variety of laws and policies affecting DOJ management including, but not limited to employment, disciplinary practices, and anti-discrimination laws, and government ethics
  • Investigate and address grievances brought by employees in partnership with the HR Director and Employee Relations Manager

  • This position will support and provide employment law advice which will include supporting complex civil litigation regarding personnel actions from the DOJ.
  • This work may involve filings and cases with OAH, EEOC, ESC, OSHR, and other various state and federal agencies.
  • This position will assist with the review, recommendation, and consultation of existing and new policies and procedures for HR.
  • This position will also review, draft, and negotiate contracts for the DOJ proactively working with Financial Services, assist the Executive Office in Administration, and the General Counsel’s office with fulfilling requests for public records.
  • This position will be providing assistance and support for MOUs, various contracts and public record requests.

The salary grade for this position is LG08. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. Please detail ALL work history including non-state service experience. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE
RECRUITMENT RANGE OF $82,808 to $96,326. Salary determination is based upon the candidate's education and experience related to the position, as well as departmental budget and equity considerations.

  • This attorney must possess extensive knowledge of federal and State case law, and administrative rules and regulations, especially in the area of labor and employment law.
  • The position requires knowledge of State and federal evidentiary and procedural rules.
  • This attorney must also possess excellent research and writing skills and oral communication abilities.
  • Ability to establish and maintain effective relationships with agency partners
  • Ability to effectively manage multiple high-level projects and deadlines simultaneously
  • Strong risk assessment and negotiation skills
  • Strong analytical skills, problem-solving skills and strategic thinking
  • Excellent verbal and written communication skills
  • Ability to independently research and propose solutions for policy, procurement and HR-related matters

This attorney must be able to perform complex and advanced legal support work.

  • This attorney must be able to work independently in determining case strategy, developing litigation tactics, and conducting litigation.
  • This attorney must be able to analyze facts, conduct discovery, conduct research, draft pleadings and briefs, argue to the court and conduct litigation in complex cases.
  • This attorney must be able to determine the potential for settlements, negotiate terms for settlement, and recommend settlements.
  • This attorney must be able to communicate effectively with a diverse population ranging from high-ranking government officials to minimum wage employees with limited education

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Management preferences: Prior governmental personnel experience or labor union expertise; prior procurement and contracting experience; prior policy experience – drafting, designing and implementing.


  • Prior experience with conflict management and mediation or alternative dispute resolution is a plus
  • Prior experience creating and delivering training is a plus
