Job Duties

About Us:

Our mission is to serve injured workers and Ohio employers through expeditious and impartial resolution of issues arising from workers' compensation claims and through the establishment of adjudication policy.

The Industrial Commission is seeking experienced licensed attorneys, preferably with Ohio workers’ compensation experience. Candidates must be customer focused and be able to professionally handle a high volume of work adjudicating first level administrative hearings. All individuals must be willing to follow policies and procedures, be able to travel to IC offices, and manage time efficiently.

What You'll Do:

Under general supervision in assigned Regions/Districts, prepares for, conducts, and issues orders from administrative hearings on Workers’ Compensation claims:

  • Hears claims on the issues of allowance, payment of compensation, payment of medical bills, determination of percentage of permanent partial disability, and any other contested claim matter except those over which the Industrial Commission (IC) or its Staff Hearing Officers have original jurisdiction.
  • Ensures all proceedings are conducted in a fair and legal manner.
  • Performs legal research into difficult questions with regard to Workers’ Compensation; participates in depositions.
  • Completes miscellaneous assignments made by the Regional Managers or any member of the IC.
  • Provides training to new Hearing Officers and Legal Interns.
  • Conducts second level hearings in the absence of Staff Hearing Officers.

Qualifications


Admission to Ohio Bar pursuant to Section 4121.34 ORC.


Knowledge of torts (i.e., employee-employer relationship & duties, responsibilities & remedies); contracts (i.e., analyze & interpret contracts pursuant to statutory & case law); legal research (i.e., use of law books & computer legal retrieval systems, & research methodology); legal analysis & writing (i.e., compose legal briefs & memoranda based on statutory & case law & rules); appellate practice (i.e., oral arguments; preparation of briefs); rules of evidence (i.e., demonstrative, testimonial & circumstantial proof; qualification & examination of witness; relevancy; documents; hearsay rule & its exceptions); workers' compensation law (i.e., Chapters 4123., 4127. & 4131. of Revised Code) applicable to issues under jurisdiction of district hearing officers (e.g., allowance of claim, payment of compensation & medical services, & determination of permanent partial disability).
Skill in use of personal computer & computer legal retrieval systems.
Ability to conduct legal research & analysis of all facts & evidence & render appropriate decision for cases under review; prepare required legal documents & related reports & records; handle routine & sensitive contacts with claimants, employers, governmental representatives, & medical providers involved in cases under review.

This position is filled through an assessment consisting of a computer-based test, written exercise, and structured interview. All parts of the assessment will be administered in person at the William Green Building in Columbus, Ohio.

This position may require travel; therefore, the person occupying this position must be able to provide his/her own transportation &/or legally operate a state owned vehicle.

Unless required by legislation or union contract, external candidates can expect starting salary to be set at the lowest rate of the salary range with gradual increases during and/or after completing probation and following successful annual performance review periods, for applicable positions.
