Overview
This Compliance Officer position provides strategy, operational leadership, and coordination for programs being developed in the Office of University Ethics and Compliance (UEC), including data privacy and outreach to the USU community, and other activities aligned with UEC's 5-year plan. The incumbent has primary responsibility for developing a privacy framework and internal controls related to the treatment of confidential and restricted data throughout USU's systems and activities, and for analyzing data management practices in all USU activities. The Compliance Officer reports to the Chief Compliance Officer (CCO) and acts in an oversight and coordinating role in conjunction with other administrators and compliance owners (e.g., Information Technology, units in the Office of Research, Human Resources, Academic and instructional Services) to implement effective systemwide programs for providing protection of USU-held data and other data governance matters. The position also has responsibility for developing and implementing outreach to the USU community related to its compliance objectives and activities, and for education and training programs to ensure understanding of USU internal controls.

The incumbent also coordinates and supports efforts in the UEC to ensure broad understanding and acceptance of USU's Compliance Framework and related compliance programs. This will include supporting and facilitating a Compliance Ambassadors Council focused on identifying and resolving common compliance issues across USU operations.

This position is telework-eligible (as a hybrid position) within the State of Utah. Telework outside the state of Utah is subject to review and approval by the University before an offer is extended.


Responsibilities
Privacy Officer
  • Act as the primary source of expertise for employees and their supervisors for information about data privacy matters, including requirements of the Health Insurance Portability and Accountability Act, the Family Educational Rights and Privacy Act, The Export Administration Regulations and other privacy-impacted regulations from the US government, state governments, and international jurisdictions that may impact USU activities or transactions.
  • Develop and maintain a data privacy framework that complements or is integrated with USUs data security framework. Coordinate with USUs Information Security Officer to ensure frameworks provide USU and its employees and students with appropriate protections for restricted, confidential, and personal data.
  • Understand and provide guidance to employees on all campuses regarding the complex regulatory requirements that surround data usage and privacy.
  • Act as USUs HIPAA Privacy Officer
  • Develop and deliver appropriate training to employees and administrators to facilitate an efficient and effective privacy program.
  • Support and coordinate with Human Resources personnel and others in developing and delivering effective training. Assess data governance training on an ongoing basis and improve compliance by delivering accurate and engaging training and communication through all effective means.
  • Provide expertise and coordination with systems developers to ensure that employees and their supervisors are providing required and effective safeguards for data use, storage and transfer.
  • Act as the owner of USUs data privacy policies under the supervision of the CCO. Continuously evaluate and improve policies and procedures related to data privacy in accordance with USU policy lifecycles guidance.
  • Support the activities of the USU Privacy Committee. Provide onboarding education and training to new committee members and maintain a regular training schedule to ensure members are aware of developing regulations and technological advancements. Encourage members to provide information about COI to colleagues in their areas of expertise.
  • Work with the CCO and department-level privacy officers to investigate, resolve and appropriately report data release incidents.
  • Participate in national and regional professional associations that provide insight into assigned functional areas, such as EDUCAUSE.

Compliance Outreach and Operations Support
  • Provide support to the CCO in developing and promoting compliance outreach and training to the USU community.
  • Assist the CCO in identifying and training candidates to serve as Compliance Ambassadors.
  • Coordinate with compliance subject matter experts to develop and deploy training and outreach programs.
  • Support assessment of USU compliance activities through data analysis, and develop reporting measures to share USUs compliance readiness with the Board of Trustees, its administration, and the public.
  • Assist with operation of USUs Hotline Reporting System.
  • Support maintenance of the USUs Compliance Matrix.
  • Provide support for other activities related to UECs mission.

Qualifications
Minimum Qualifications
  • Bachelor's degree with a minimum of 2 years of experience within a compliance, legal, or risk management function
  • Demonstrated ability to work unsupervised, exercise leadership, and influence change
  • Demonstrated organizational, facilitation, written and oral communication, and presentation skills
  • Well-developed professional and interpersonal skills; ability to interact effectively with people at all organizational levels of the University
  • Demonstrated experience in establishing and maintaining compliance or internal control systems in an academic setting
  • Strong working knowledge of Microsoft Office 365 software, document collaboration software including Box, and team collaboration systems such as Zoom or Team

Preferred Qualifications
  • Master of science, human resources, legal or public administration degree
  • Demonstrated knowledge and experience that has supported increasing responsibilities and achievements in compliance, administrative and/or legal activities
  • Two years of experience in decentralized organizations collaborating with multiple departments/units and/or multiple constituencies while also meeting the needs of the organization as a whole is strongly desired
  • Working knowledge of state and federal requirements and international standards for data privacy, including the Health Insurance Portability and Accountability Act, the Family Rights and Privacy Act, the Export Administration Regulations, the General Data Protection Regulation, the Personal Information Protection Law (China) and applicable state laws
